The “OFCCP Week in Review” is a simple, fast and direct summary of relevant happenings in the OFCCP regulatory environment published every Friday. Here are this week’s developments:

February 26, 2015: The Subcommittee on Workforce Protections and the Subcommittee on Health, Employment, Labor and Pensions held a hearing on “The Blacklisting Executive Order: Rewriting Federal Labor Policies through Executive Fiat” on this day. President Obama signed EO 13673 in July 2014, which requires employers to report any violations of 14 federal labor and employment laws going back three years in order to compete for a federal contract. This order is intended to take effect in 2016. The EO applies to all contracts worth at least $500,000, requires contractors to disclose to the best of their knowledge “any administrative merits determination, arbitral award or decision, or civil judgment” rendered against the business for violations of federal employment discrimination laws, the Fair Labor Standards Act, the National Labor Relations Act and the Family Medical Leave Act, among other statues and existing executive orders. Contractors are also required to inform the federal government about violations of “equivalent state laws” over the same three-year period.
